This licensing framework governs all audio productions, orchestrations, mockups, scores, recordings, arrangements, technical documents, and related deliverables provided by EMSAM PRODUCTIONS.
2. LICENSE FOR INDIVIDUAL COMPOSERS & PERSONAL PROJECTS
2.1 Rights Granted
For individual composers, musicians, directors, and small-scale personal projects, EMSAM PRODUCTIONS grants a full, perpetual, worldwide license over the delivered master. This means:
- The client may freely use, modify, distribute, monetize, or publicly release the final audio without any obligation to credit EMSAM PRODUCTIONS as the author.
- All intellectual ownership of the original musical work (composition) remains exclusively with the client.
2.2 Limitations
This license does not include:
- Access to raw session files, multi-tracks, MIDI data, or internal production templates.
- Any claim by EMSAM PRODUCTIONS over the composition itself beyond the production process.
3. LICENSE FOR COMMERCIAL PRODUCTIONS (FILM, GAMES, BRANDS)
3.1 Rights Framework
For commercial productions involving film, television, series, advertising campaigns, videogames, brand promotions or sync licensing, EMSAM PRODUCTIONS requires an extended license agreement, negotiated separately.
3.2 Possible Additional Terms
Such agreements may include:
- Royalties or profit-sharing based on revenues, streams or unit sales.
- Mandatory credit attribution in all public releases and marketing.
- Restrictions on sublicensing or distribution to third parties.
4. WARRANTIES & DISCLAIMERS
All productions are delivered as high-quality masters. EMSAM PRODUCTIONS does not warrant compatibility with every playback system or editing software beyond standard industry formats.
EMSAM PRODUCTIONS is not liable for any misuse, misrepresentation, or unauthorized exploitation of the delivered materials once licensed.
5. COPYRIGHT OWNERSHIP
5.1 Personal Projects
In the case of personal commissions by composers or independent artists, all intellectual ownership over the composition and resulting audio remains with the client. EMSAM PRODUCTIONS acts solely as the technical producer.
5.2 Commercial Works
For larger commercial agreements, EMSAM PRODUCTIONS retains intellectual property rights over the production process (orchestration, mockups, proprietary techniques), subject to the extended license terms negotiated with the client.
6. ACCEPTANCE OF TERMS
By engaging EMSAM PRODUCTIONS and accepting delivery of any audio or related products, the client acknowledges and agrees to these licensing conditions.
Copyright
All original works produced by EMSAM PRODUCTIONS—whether they involve composition, orchestration, mockups, or recordings—are protected under international copyright law.
This protection applies to:
• Original music composed by EMSAM PRODUCTIONS.
• Custom orchestrations or arrangements created for clients.
• Virtual or hybrid recordings made with or without real instruments.
• Classical works recreated from the public domain (these are new recordings
and are protected as original phonograms).
Demo Recordings of Copyrighted Works
Any demo productions of copyrighted works (including but not limited to soundtracks from movies, series, and video games) are provided solely as portfolio samples to demonstrate production and orchestration capabilities. These are not intended for sale or distribution and remain under fair use or similar principles applicable to artistic demonstration. Use of this website implies acceptance of these terms. Copying, redistributing, or commercially exploiting any part of the material presented without explicit written permission is strictly prohibited.
Public Domain Recordings
Even when a composition is in the public domain, the recording produced by EMSAM PRODUCTIONS remains a protected phonographic work. Clients may not copy, distribute, or use EMSAM’s recordings for commercial purposes without prior written authorization.
Client Ownership and Licensing Scope
Clients who are individuals or small creators—such as composers, soloists, educators, or musicians—retain full ownership of their commissioned work, including both the musical content and the final audio master. EMSAM PRODUCTIONS will not claim authorship or usage rights over their commissioned material.
For commercial or industry-level projects—such as film studios, video game developers, or advertising agencies—ownership and licensing terms are specified in a separate contract, which may include partial or shared rights depending on the nature and scale of the agreement.
